We, i.e. WAFIOS Aktiengesellschaft, collect and process data for the purpose of carrying out contracts and fulfilling our contractual or pre-contractual and legal obligations. Moreover, personal data may be processed for direct marketing purposes.
We collect and store the following data:
- Salutation, title if applicable, first and last name
- Address
- Function or Position
- Telephone number (land line and/or mobile)
- If necessary, fax number
- If necessary, e-mail address
- Information on the implementation of the contract
Your data must be collected and processed in order to be able to implement the contract and is based on the GDPR, Article 6, Paragraph 1, Sentence 1, Letter b or - in case of legitimate interest - on the GDPR, Article 6, Paragraph 1, Sentence 1, Letter f. The basis for the latter is a balancing of interests. There are no restrictions on the fundamental rights and freedoms of natural persons. If data is collected and processed on the basis of consent, this is done on the basis of Article 6, Paragraph 1, Sentence 1, Letter a. The legal basis for processing due to the fulfillment of a legal obligation is GDPR Article 6, Paragraph 1, Sentence 1, Letter c.
Personal data is processed by us for the following purposes:
- Identification of the customer/supplier or contact person
- Consultation of the customer or the contact person
- Execution, management and processing of orders
- Processing and documentation of complaints or damage cases
- Documentation or verification of agreements and conditions
- Correspondence
- Invoicing, if necessary dunning
- Permissible direct advertising
- Assertion of claims
- Fulfillment of legal obligations
Personal data is only provided to persons in the company who need it for the above-mentioned processing activities. Personal data is only passed on to third parties within the framework of the fulfillment of the contract or to ensure business operations. This includes the transfer to service providers commissioned by us or other third parties whose services are necessary for implementation of the contract. This includes, for example, suppliers or freight forwarders. Personal data may be used by third parties only for the purposes specified above. Moreover, order processors involved by us, in particular IT and back-office providers, receive personal data from our customers or suppliers if this is necessary for the performance of the service. All processors are contractually obliged to treat customer and supplier data confidentially and to process it only for the performance of services.
Moreover, data is exchanged within the group if there is a legitimate interest on our part. Data is exchanged with other companies in the group to simplify and optimize administration or to supplement the range of services.
The data is deleted as soon as it is no longer required for the purpose of its processing and no legal requirements restrict deletion.
Those affected have the right to object to the use of their data at any time if it is processed by us on the basis of a legitimate interest (e.g. direct advertising). Moreover, those affected are entitled to request information about the data we have collected about you. If there are inaccuracies, you can demand correction. You may also request the deletion of the data collected by us, provided there are no legal provisions to the contrary. In certain cases it is possible that we restrict the processing of your data at your request.
